Many environmental decisions have a discretionary nature, i.e. the authorities are entitled to decide whether to make a decision and/or its contents. Making such a decision can be a complicated task. The decision-maker faces multiple interests and facts, which all have to be considered. The final decision may have an important environmental impact and therefore must be legal, balanced and in conformity with all applicable requirements.
EELC is to publish practical guidelines on making discretionary decisions in November 2013 and they will be made available via our webpage. The project activities will also include three trainings in different parts of Estonia to introduce the guidelines.
